Future law: ONCA
Ontario’s Not-for-Profit Corporations Act (ONCA) is expected to replace the Ontario’s Corporations Act in 2020. This section of the website will help you understand whether:
- the ONCA applies to you
- if it does, when you have to start making changes
- what changes you may need to make
While existing nonprofits must change their articles or letters patent to comply with ONCA, they are not required to pass new bylaws. However, it’s a good idea to update your bylaws. If you don’t, your nonprofit will have a set of bylaws that don’t reflect the rules that apply to your nonprofit.
The steps listed below will help you prepare for the ONCA by updating your bylaws. They will not help with updating your articles.
