Transition to ONCA

Ontario’s Not-for-Profit Corporations Act (ONCA) replaced Ontario’s Corporations Act on October 19, 2021. This section of the website will help you understand whether:

  • the ONCA applies to you
  • if it does, when you have to start making changes
  • what changes you may need to make

While existing nonprofits must change their articles or letters patent to comply with ONCA, they are not required to pass new bylaws. However, it’s a good idea to update your bylaws. If you don’t, your nonprofit will have a set of bylaws that don’t reflect the rules that apply to your nonprofit.
